Application Privacy Statement

Saberpoint, LLC (collectively with its affiliates, subsidiaries and parent companies, "Company" or "us"), owns this mobile application named SAFE (Safety App for Emergencies), as has been branded for use by Fordham University ("Fordham") (collectively with all services related thereto and all updated, versions and new releases, the "Application"). Fordham is licensing the Company's technology to provide this Application to its students and staff. This Mobile Application Privacy Statement ("Privacy Policy") discloses Company's privacy practices concerning the Application. The Privacy Policy is subject to and incorporated into, and is a part of, the Application Terms of Use Agreement. The Company desires to provide end-users ("User", "you" or "your") with transparency regarding the use of their information. The Application is a supplemental warning tool that allows its users to quickly, silently, and securely send emergency request or "S.O.S" messages from their mobile phones to a central, on-site safety office managed by Fordham.

The information you provide or is otherwise collected will be accessible by the Company, Fordham and their respective designees as more fully described below. By downloading the Application, you consent to the terms of this Privacy Policy. If you do not agree, or otherwise object, to the terms herein, you should not download or use this Application.

User Provided Information

The Application obtains the information you provide when you download and register the Application. Registration is mandatory in order to be able to use the basic features of the Application. When you register and use the Application, you generally provide (a) your name, telephone number, email address, age, user name, password and other registration information; (b) information you provide us when you contact us or Fordham, or utilize the Application, for help in an emergency or crisis; and (c) other information you enter into our system when using the Application.

The Company or Fordham may also use the information you provided us to contact you from time to time to provide you with important information, updates and notices in connection with the Application.

Automatically Collected Information

The Application may also collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, browser type, and your mobile operating system. This Application does not collect precise information about the location of your mobile device at all times. The Application will not be used to track you or provide your location unless you request help, which may include you providing your location at such time or the automatic identification of your location when you request help.

Data Retention Policy, Managing Your Information

None of your personal information will be stored on our servers. Fordham will have control over all of the personal information you provide, and will retain such information in accordance with Fordham's policies. Only requests for help through the Application will be stored on our servers for auditing purposes, which will include your help request, profile, details and location at the time that you requested assistance

Sharing Your Information; Retention of Information

Company does not rent, sell or share the information you have allowed us to collect with third parties, except Fordham, without your permission. However, we may share your information we retain without your permission (i) pursuant to judicial or other government subpoenas, warrants, or orders or otherwise to comply with law; (ii) where Company believes the rights, property or an individual's safety or security is at risk; (iii) if Company finds that your actions violate our Terms of Use Agreement or to otherwise protect Company's rights; and (iv) with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Privacy Policy, or (v) where otherwise required by law. In the event the Company is acquired, merges with another company, or sells certain assets, the Company may provide such User information, subject to this Privacy Policy, that is related to that part of our business that was sold or merges with the other entity without your consent solely in order that such entity may be able to continue to maintain the Application and related services.

Subject to the disclosures in this Privacy Policy and applicable law, we will retain your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device.

Children's Privacy

The Company is committed to protecting the safety and privacy of young people using the Internet. Our services, products and websites are not directed at children under the age of 13 and we do not knowingly collect personal information from children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at notices@saberpoint.com. We will delete such information from our files within a reasonable time.


We are concerned about safeguarding the confidentiality of your information. We provide physical, technical, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to Fordham, authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches. Of course, although Company uses standard industry practices to protect and safeguard your data, we cannot guarantee that your communications with Company or your data will never be unlawfully intercepted, or that your data will never be unlawfully accessed by unauthorized third parties.


This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by updating the Privacy Policy in the Application You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing," means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
